1. General Provisions & Acceptance

These terms govern your use of the website and the purchase of products (Atelier and Studio lines). These terms are supplementary to, and do not replace, the specific Distance Sales Contract (Mesafeli Satış Sözleşmesi) and Preliminary Information Form (Ön Bilgilendirme Formu) presented upon making a purchase.

In the event of any conflict regarding a consumer sale, the Distance Sales Contract, the Preliminary Information Form, and the mandatory rules of consumer legislation prevail.

2. Intellectual Property Rights (The "Design Protection" Clause)

The entire content of this website is the exclusive property of ARTENISA and is protected under the Turkish Law on Intellectual and Artistic Works No. 5846 (Fikir ve Sanat Eserleri Kanunu) and international copyright treaties.

A. Scope of Protection

This protection extends to, but is not limited to:

• The Designs: The sculptural forms, 3D geometries, and aesthetic configurations of all Atelier (sculpture) and Studio (collectible) items.
• The Visuals: All product photography, "hero" shots, videos, and brand imagery.
• The Code & Brand: The logo, “Artenisa” trade name, website source code, and written copy.

B. Strict Usage Rules

• No Commercial Reproduction: The purchase of an ARTENISA product grants you ownership of the physical object only. It does not grant any rights to reproduce, copy, scan, reverse-engineer, or manufacture the design.
• No Digital Theft: Users are prohibited from using scraping tools, data mining, or automated bots to extract design data or images from this site.
• Legal Action: Any unauthorized reproduction of our unique designs (knock-offs) or unauthorized use of our photography may result in legal action under applicable legislation.

3. Prohibited Conduct

By using this site, you agree NOT to:

• Use the website for any unlawful purpose or to solicit others to perform unlawful acts.
• Attempt to reverse-engineer any portion of the site’s technology or source code.
• Place false or fraudulent orders. We reserve the right to cancel orders that appear to be placed by dealers, resellers, or distributors without prior authorization.
• Interfere with the security features of the website (e.g., uploading viruses or malware).

4. Products & Accuracy

• Visual Representation: We aim to display colors and textures as accurately as possible. However, screens vary, so visuals may differ slightly from the physical product.
• Nature of Goods: Our products may include natural variations (wood grain, stone texture) or process marks (e.g., 3D printing layers). These are characteristics of the craft.

5. Limitation of Liability

• Service Availability: We do not guarantee uninterrupted access. We may temporarily suspend the website for maintenance, security, or operational reasons. Where reasonably possible, we will provide notice, but urgent situations may require immediate action.
• Third-Party Links & Services: This site may reference third-party services (e.g., payment providers and social platforms). We are not responsible for third-party content or policies.
• Consumer Rights: Nothing in this section is intended to limit or exclude mandatory consumer rights under Law No. 6502. Your statutory rights remain unaffected.

7. Governing Law & Dispute Resolution

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the Republic of Türkiye.

• Consumer Disputes: Consumers may apply to the Consumer Arbitration Committee (Tüketici Hakem Heyeti) or Consumer Court (Tüketici Mahkemesi) in their place of residence or where the consumer transaction is made, within the monetary limits determined annually by the Ministry of Trade.
• Non-Consumer / Commercial Disputes: For disputes that are not consumer disputes, Ankara courts and enforcement offices may be authorized.
